PLEASE READ THIS DOCUMENT CAREFULLY. ParkEvergreen, Inc. (DBA: Plot) (“Plot”, “we” or “us”) may update this privacy policy (“Privacy Policy”) from time-to-time in our sole discretion. It is your responsibility to review the Privacy Policy for any changes each time that you use the mobile application and its services (“Application” or “Services”) and you are bound by such changes. If you do not agree to the terms and conditions of this Privacy Policy, including the use of your personally identifiable information in any manner described here, you may be prohibited from using much of our Services, including revocation of your membership. Your use of the Services constitutes your acceptance of the Privacy Policy effective on that date of use.

What information do we collect?

  • Registration information - When you sign up for the Service, we ask for your personal information. We may collect and store any personal information you provide to us in some other manner, including personal information that may be contained in any video, comment or other submission you upload or post to the Application. This includes identifying information, such as your name, address, e-mail address, and telephone number; your likeness; and, if you transact business with us, financial information such as your payment method (valid credit card number, type, expiration date or other financial information). We may store that information and also collect and store metadata about that information. We also may request information about your interests and activities, your gender and age, and other demographic information.

  • Information obtained from third parties - We may obtain information about you from third parties to verify the information you provide. We also may obtain information from third parties in connection with providing the Services to you. This information may be collected across time and across third party websites. We may also periodically obtain both personal and non-personal information about you from other business partners, contractors and other third parties. Examples of information that we may receive include: updated delivery and address information, purchase history, and additional demographic information.

  • Information collected from third parties - We may allow third-parties, including our authorized service providers, IAC companies, advertising companies, and ad networks, to display advertisements on our Application. These companies may use tracking technologies to collect information about users who view or interact with their advertisements. This information may be used across time and across third party websites and allows them to deliver targeted advertisements.

  • Information about others - We may also collect and store personal information about other people that you provide to us. If you use the application to upload, share and/or distribute content (including videos, comments or other submissions), and such content contains personal information about others, such information may be stored in order to allow for such uploading, sharing and/or distribution.

  • Information about your use of the service - We may collect information about your interaction with the service to help validate your identity or detect potentially fraudulent conduct.

  • Cookies - When you access the Plot Website or Software, we may send one or more cookies (“cookies” are small text files containing a string of alphanumeric characters) to your computer or device that uniquely identifies your browser and allows Plot to help you log in faster and enhance your navigation on the Application. A cookie may also convey information about how you use the Service (actions you take, links you click, and so on), allowing Plot to track your usage over time.

  • Log information - When you use the Application, our servers may automatically record information. These server logs may include information such as your web request, Internet Protocol address, browser type, browser language, the date and time of your request and one or more cookies that may uniquely identify your browser.

  • User communications - When you send an email or other communication to us or other Application users.

  • Links - We may present links in a format that enables us to keep track of whether these links have been followed.

What do we use your information for?

  • To personalize your experience – Your information helps us better respond to and tailor our Services to your individual needs.

  • To improve our Website and Software – we continually update and improve our Services based on the information and feedback we receive from you.

  • To improve customer service

  • To Sell or Share – we may share or sell information with third parties for marketing or other purposes without your consent.

  • To administer promotions, surveys or other Website or Software features

  • To send you periodic emails – the email address you provide for registration purposes may be used to send you information about this application, in addition to occasional news, updates, related product or service information (including, but not limited to sharing such information with third parties), etc.

  • Plot reserves the right to use information gathered by it for any and all purposes. You understand and agree that Plot can and will use your personally identifiable information in any manner, including but not limited to selling, renting, and/or sharing your email, physical address or other personal information with third parties. If you do not want your personal information shared, you may write to us at unsubscribe@plotme.co. You understand and agree that any decision you make to withhold any personally identifiable information may prevent Plot from being able to fulfill your request and/or purposes in using the Services.

With Whom We Share Your Information

It is important that you understand that we may share personal or other information we have collected about you or your activities while using our services.

Personal information. We may share your personal information with:

Authorized service providers: We may share your personal information with our authorized service providers that perform certain services on our behalf. These services may include fulfilling orders, processing credit card payments, delivering packages, providing customer service and marketing assistance, performing business and sales analysis, supporting our Application functionality, and supporting contests, sweepstakes, surveys and other features offered through our Application. These service providers may have access to personal information needed to perform their functions but are not permitted to share or use such information for any other purposes.

Other business partners: We may share personal information with the businesses with which we partner to offer you those products, services, promotions, contests and/or sweepstakes.

Direct mail partners: From time to time we may share our postal mailing list with selected providers of goods and services that may be of interest to you.

Miscellaneous Third Parties: From time to time we may share, rent or sell the aggregated and non-personal information and or personal information we collect to third parties.

Other Situations: We also may disclose your information:

  • In response to a subpoena or similar investigative demand, a court order, or a request for cooperation from a law enforcement or other government agency; to establish or exercise our legal rights; to defend against legal claims; or as otherwise required by law. In such cases, we may raise or waive any legal objection or right available to us, in our sole discretion.

  • When we believe disclosure is appropriate in connection with efforts to investigate, prevent, report or take other action regarding illegal activity, suspected fraud or other wrongdoing; to protect and defend the rights, property or safety of our company, our users, our employees, or others; to comply with applicable law or cooperate with law enforcement; or to enforce our Terms and Conditions or other agreements or policies.

  • In connection with a substantial corporate transaction, such as the sale of our business, a divestiture, merger, consolidation, or asset sale, or in the unlikely event of bankruptcy.

Any third parties to whom we may disclose personal information may have their own privacy policies, which describe how they use and disclose personal information. These entities or their servers may be located either inside or outside the United States.

How do we protect your information?

  • We take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data. Our measures include external reviews of our data collection, storage and processing practices and security measures, as well as technical security measures to guard against unauthorized access to systems where we store personal data.

  • The security of your account also depends on keeping your account password confidential and you should not share your account name or password with anyone. If you do share your account information with a third party, they will have access to your account and your personal information.

Accessing and Editing Your Personal Information

You have the ability to access and edit any personal information held on the Application. You may do so by logging into your profile and changing any user information stored on file there. To the extent that such information is stored in our databases, we will respond to your changes as soon as reasonably possible. Please note that although you may delete this information from your profile, the information may remain stored indefinitely in our backup and archival records. While your personal information is protected as outlined above, we reserve the right to use, transfer, sell, and share aggregated, anonymous data about our users as a group for any business purpose, such as analyzing usage trends and seeking compatible advertisers and partners.

Do Not Track Signals

At this time we do not respond to Do Not Track Signals.

Third party links

Occasionally, at our discretion, we may include or offer third party products or services on our Website or Software. These third party sites have separate and independent privacy policies. We therefore have no responsibility or liability for the content and activities of these linked sites. Nonetheless, we seek to protect the integrity of our Application and welcome any feedback about these sites.

Age Restrictions

We are in compliance with the requirements of COPPA (Childrens Online Privacy Protection Act), as we do not collect any information from anyone under 13 years of age. Our Application and Services are all directed to people who are at least 13 years old or older. If you are under the age of 13, please do not submit any personal information through the Application.

Changes to this policy

Please note that this Privacy Policy may change from time to time. We will post any Policy changes on this page. Each version of this Policy will be identified at the top of the page by its effective date.
